1. Tuition must be paid in full before the first classroom session begins. Payment can be made using a credit card, debit card, personal check or money order and cash. There will be a $35.00 service charge for all returned or cancelled payments/checks(NSF). There will be a one hundred fifty ($150.00) dollar administrative fee for all approved refunds due to cancellations by student or guardian. 2. All books and educational supplies are the property of NC DRIVING 101 and must be returned, in good condition, at the completion of the course i.e. at time prior to Final Exam. 3. The student will receive classroom instructions. Students must complete ALLclassroom instruction to receive a Driver's Training Certificate. NC DRIVING 101 will complete the course in a reasonable length of time. However, NC Driving 101 cannot be held responsible for delays caused by mechanical failure or any other reason over which NC DRIVING 101 has no control. NC DRIVING 101 will give the Student as much notice as possible if any delay becomes necessary (or foreseen). ). A fee of $25.00 will be charged for replacement of lost end of class certificates. A Student who is late five-minutes or more is considered absent and will not be admitted into that day’s class. If the course has not been completed or a class is missed by the student, there is a re-enrollment fee of $125.00. A student who has missing two or more classes is required to retake the class at the then current class rate. Students may retake each end of class evaluation two (2) time. 4. Cancellation of special testing appointments must be made at least 24 hours before the scheduled appointment. Students will be charged $50.00 if cancellation is made less than 24 hours before the appointment begins. 5. Intentially left blank! 6. This waiver must be signed by the student and parent or legal guardian and returned to NC DRIVING 101 by the first day of class. Student will not be able to attend class until the contract is received and all fees are paid in full. 7. While NC DRIVING 101 will exert its best efforts in teaching the student to meet the requirements of the NC Division of Motor Vehicles examination; the school cannot guarantee that the student will successfully pass the Division of Motor Vehicle exam upon completion of the course. The school does agree to exert its best efforts in teaching the Student to meet the requirements of the examination. 8. This agreement constitutes the entire waiver between the school and the student, and any verbal assurances or promises not contained herein shall bind neither the school nor the student. 9. The school will not refund any tuition monies or any part thereof when actual services have been rendered. 10. All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainer(s) at the Taught Courses are, and remain, the intellectual property of NC DRIVING 101 or its licensors, whether adapted, written for or customized for the Client or not. You are not authorized to:
(i) copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;
(ii) record on video or audio tape, relay by videophone or other means the Online Course or Taught Course given
(iii) use the Course Materials in the provision of any other course or training whether given by us or any third-party trainer;
(iv) remove any copyright or other notice of NC DRIVING 101 on the Course Materials;
(v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.
(vi) share the webinar login information with anyone not signed up and paid for the class.
11. NC DRIVING 101 shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation. 12. NC DRIVING 101is licensed by the State of North Carolina, Division of Motor Vehicles Vehicles and School Bus Traffic Safety (SBTS) Section. To the extent permitted by law, student and parent or legal guardian agree to indemnify and hold harmless NC DRIVING 101 from all damages, expenses, fees, fines or other amounts occasioned by the acts of student at any time. It is acknowledged that this indemnification language is clear, concise and unambiguous and not unduly burdensome. It is also acknowledged that NC DRIVING 101 would not agree to the terms of this Agreement unless such indemnification is granted by student and parent or legal guardian and that the same is an integral part of this Agreement. NC DRIVING 101 is not responsible for the future driving performance of students enrolled in this program. 13. NC DRIVING 101 does not guarantee the student will pass the North Carolina Department of Motor Vehicle written and traffic sign exam. In the event of student failure of test, no refund will be given. 14. If a student appears to be intoxicated or impaired by alcohol or drugs the student will be dismissed from the course. 15. Cell phones use other than for life virtual class are prohibited in this virtual classroom setting. 16. Photos and videos can be taken for advertising purposes. 17. No profanity will be tolerated in the classroom and/or abuse of any kind directed at the instructor or other students will not be accepted and will be subject to immediate dismissal from the class. 18. NC DRIVING 101 may hold this class via enterprise video conferencing optimizing the Zoom or similar internet conference platform. The School will schedule and Student will join meetings through Student’s email or calendar invite application. Zoom's video communications product suite runs on mobile, desktop, and conference room systems. Student will be required to use a single point of use computer and shall not share the computer with another participant. Parent and student understand that the student will be required to keep their computer camera on during the entire class period (except for incremental scheduled breaks). BEHIND THE WHEEL TRAINING - Tuition for the Behind-The-Wheel must be paid in full. If payment has not already been made as part of the program, payment can be made using a credit card, debit card, personal check, or money order. There will be a $35.00 service charge for all returned payments/checks(NSF).There will be a one hundred fifty ($150.00) dollar administrative fee for all approved refunds due to cancellations by student or guardian. If a behind-the-wheel session is cancelled less than 24 hours before the scheduled appointment, no refund will be provided. 19. Parent/Guardian, Student, and NC DRIVING 101representative must complete the SBTS-800/Restricted Instruction Permit (RIP) prior to student being permitted to drive with an instructor for the behind-the-wheel training. 20. The student will receive behind-the-wheel training. Students must complete the in-car behind-the-wheel training with NC DRIVING 101. Upon successful completion, Student will receive a Driver's Training Certificate. NC DRIVING 101 will complete the course in a reasonable length of time. However, NC Driving 101 cannot be held responsible for delays caused by mechanical failure, unsafe driving conditions, or any other reason over which NC DRIVING 101 has no control. NC DRIVING 101 will give the Student as much notice as possible if any delay becomes necessary (or foreseen). A fee of $25.00 will be charged for replacement of lost completion certificates. Cell phones are prohibited during the behind the wheel training. If a student appears to be intoxicated or impaired by alcohol or drugs the student will be dismissed from the behind the wheel training and no refund will be issued as a result thereto. 21. In the event additional driving time is needed students or adults may schedule additional sessions at the then current rate per hour. 22. Driving appointments for the student will be scheduled depending on the availability of NC DRIVING 101 instructor(s), weather conditions, state mandate and subject to all fees being paid in full. All driving instructions will be held within 20-mile radius of Harrisburg, NC unless otherwise previously approved by NC Driving 101. 23. Cancellation of driving appointments must be made at least 48 hours before the scheduled appointment. See Refund Policy. 24. Students and parents or legal guardians will be responsible for any damage to NC DRIVING 101 materials and automobiles during ordinary course of driving with an instructor, even when students are learning how to drive. If student is out on the roads and highways, student still has a legal duty to drive in a reasonably safe manner. That means obeying stop signs and traffic signals, checking blind spots before changing lanes, yielding correctly, staying on their side of the road (i.e. not crossing over the center line into oncoming traffic nor driving over the right boundary line onto the shoulder), avoid colliding with curbs that potentially damages tires and wheels, and obeying posted speed limits. 25. Student Cell Phones are prohibited in the automobile and shall be turned off or set to Do Not Disturb While Driving. 26. Dashboard camera maybe be used during the behind the wheel lesson. 27. Waiver of Liability Relating to Coronavirus/COVID-19.
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
NC Driving 101 cannot prevent you [or your child] from becoming exposed to, contracting, or spreading COVID-19 while utilizing NC Driving 101’s services or vehicle. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize NC Driving 101’s services and/or enter into NC Driving 101’s vehicle you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize NC Driving 101’s services and enter NC Driving 101’s vehicle. These services are of such value to me [and/or to my children,] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize NC Driving 101’s services and vehicle in person. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against NC Driving 101 and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing NC Driving 101’s services and vehicle(s). I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
28. Dress Code The dress and grooming of students shall contribute to the health and safety of the individual and promote an orderly educational environment. All students participating in the NC Driving 101 behind the wheel training program must follow the code of conduct and dress for NC Driving 101. Please see what not to wear below:
No hoodies, do-rags, or scarves (unless for religious purpose) during driving training
No tanks tops, no revealing, thin strapped, or see-through tops
No bare midriffs
No sagging pants or shorts
No short skirts or shorts that are above the knees
No clothing that advertises drugs, alcohol, tobacco, illegal substances or activities
No bare feet
No bedroom slippers, sandals, flip-flops, mules, clogs, or platform shoes
No taps, ghillies, or cleats
No headphones or ear-buds
