NC Driving 101 may reschedule class(es) due to insufficient enrollment or other extenuating circumstances. Students enrolled in reschedule classes will received written notice of the rescheduled class. Students will be admitted automatically into the next available class. The driving portion is after the successful completion of the classroom, the physical & eye evaluation and will be scheduled for later dates. Tuition for the complete NC DRIVING101 Behind-The-Wheel training must be paid in full 2 business days before the first session begins. All books and educational supplies are the property of NC DRIVING 101 and must be returned, in good condition, at the completion of the course i.e. at time prior to Final Exam. 3. The student will receive classroom training. Students must complete all classroom hours of instruction to receive a Driver's Training Certificate. NC DRIVING 101 will complete the course in a reasonable length of time. However, NC Driving 101 cannot be held responsible for delays caused by mechanical failure or any other reason over which NC DRIVING 101 has no control. NC DRIVING 101 will give the Student as much notice as possible if any delay becomes necessary (or foreseen). A fee of $25.00 will be charged for replacement of lost or duplicate/replacement end of class certificates. Students may retake each end of class evaluation two (2) time. 4. Cancellation of a class or a special testing appointments must be made at least 48 hours before the scheduled appointment. Student may reschedule the class to a later time slot if they have not started the class the signed up for yet. There is a re-enrollment fee of $125. All cancellations must be in writing and a receipt response from NC Driving 101 is required. Should a student starts a class, there will be no refund if they opt, for any reason, to drop or reschedule the class for a later time. 5. The class waiver must be signed by the student and parent or legal guardian and returned to NC DRIVING 101 by the first (1st) day of class. Student will not be able to attend class until the contract/waiver is received and all fees are paid in full. 6. While NC DRIVING 101 will exert its best efforts in teaching the student to meet the requirements of the NC Division of Motor Vehicles examination; the school cannot guarantee that the student will successfully pass the Division of Motor Vehicle exam upon completion of the course. The school does agree to exert its best efforts in teaching the Student to meet the requirements of the examination. NC DRIVING 101 does not guarantee the student will pass the North Carolina Department of Motor Vehicle written exam. In the event of student failure of test, no refund will be given. 7. The school will not refund any tuition monies or any part thereof when actual services have been rendered or the student or parent has not requested a different time slot at least 48-hours before class start. A re-enrollment fee of $125 will be applicable at the time of rescheduling. 8. All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainer(s) at the Taught Courses are, and remain, the intellectual property of NC DRIVING 101or its licensors, whether adapted, written for or customized for the Client or not. You are not authorized to: (i) copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission; (ii) record on video or audio tape, relay by videophone or other means the Online Course or Taught Course given (iii) use the Course Materials in the provision of any other course or training whether given by us or any third-party trainer; (iv) remove any copyright or other notice of NC DRIVING 101 on the Course Materials; (v) modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses. 9. NC DRIVING 101 shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation. 10. NC DRIVING 101is licensed by the State of North Carolina, Division of Motor Vehicles. To the extent permitted by law, student and parent or legal guardian agree to indemnify and hold harmless NC DRIVING 101 from all damages, expenses, fees, fines or other amounts occasioned by the acts of student at any time. It is acknowledged that this indemnification language is clear, concise and unambiguous and not unduly burdensome. It is also acknowledged that NC DRIVING 101 would not agree to the terms of this Agreement unless such indemnification is granted by student and parent or legal guardian and that the same is an integral part of this Agreement. NC DRIVING 101 is not responsible for the future driving performance of students enrolled in this program. 11. If a student appears to be intoxicated or impaired by alcohol or illegal drugs the student will be dismissed from the course and no refund will be given. 12. Cell phones use other than for this life virtual class are prohibited in this virtual classroom setting. 13. NC Driving 101, will have every right to expel a student from class for misconduct. This is at the sole discretion of NC Driving 101. 14. NC DRIVING 101 may hold this class via enterprise video conferencing optimizing the Zoom or similar internet conference platform. The School will schedule and Student will join meetings through Student’s email or calendar invite application. Zoom's video communications product suite runs on mobile, desktop, and conference room systems. Student will be required to use a single point of use computer and shall not share the computer with another participant. Parent and student understand that the student will be required to keep their computer camera on during the entire class period (except for incremental scheduled breaks).Neither student nor parent is permitted to tape or record any part of our zoom meeting without prior written consent of NC Driving 101. Should NC Driving 101 consent to a taping, student nor parent shall share the tape with ANYONE nor shall they post it on the Internet or any social media site. 15. Attendance: North Carolina state law requires that students attend all of classroom instruction. Missed classes must be made up and completed during another session. Locations for makeup dates are subject to change and cannot be guaranteed. If a student misses one but no more than 2 classes, a make up fee of $125 will charged for each missed class. If students arrive 10 or more minutes late or leave class 10 or more minutes early unless initiated by the instructor, this will be counted as a one-hour absence. A student automatically fails after 3 missed 10-minute class increments and will be required to make up the missed classes during one of the upcoming sessions. If the student opts not to attend the first class and notifies NC Driving 101 in writing at least 48-hours in advance, student may switch to one of the next held program class sessions by paying a reschedule fee of $150 (a seat will not be reserved until payment has been made in full). 16. Parent/Guardian, Student, and NC DRIVING 101representative must complete the SBTS-800/Restricted Instruction Permit (RIP) and student must have taken the appropriate Vision & Medical Screening prior to student being permitted to drive with an instructor for the behind-the-wheel training. NC DRIVING 101 is certified to perform these screening. 17. The student will receive behind-the-wheel training. Students must complete of the in-car behind-the-wheel training with NC DRIVING 101. No parent, guardian or sibling is legally permitted to attend the behind-the-wheel training in the driver education vehicle. Upon completion of the training, Student will receive a Driver's Training Certificate. NC DRIVING 101 will complete the course in a reasonable length of time. However, it cannot be held responsible for delays caused by mechanical failure, unsafe driving conditions, or any other reason over which NC DRIVING 101 has no control. NC DRIVING 101 will give the Student as much notice as possible if any delay becomes necessary (or foreseen). A fee of $25.00 will be charged for replacement of lost completion certificate. 18. In the event additional driving time is needed for the teen students parent or guardian may schedule additional sessions at the rate of $75 per hour (or the then prevailing rate). 19. Driving appointments for the student will be scheduled depending on the availability of NC DRIVING 101 instructor(s), weather conditions, state mandate and subject to all fees being paid in full. Due to high demand, there may be a backlog for behind the wheel training. We encourage you check with with NC DRIVING 101 before signing up for the program, to ensure NC DRIVING 101 can meet your specific needs. NC DRIVING 101 will not be responsible if you decide to sign up without without confirming your specific need(s) prior to signing up for the class and behind the wheel training or any combination thereto. No refunds will be issued if services have been rendered regardless of the program(s) that were selected/signed up for. 20. Cancellation of driving appointments must be made at least 48 hours before the scheduled appointment. If a student cancels the entire behind-the-wheel session at least 48 hours before the first scheduled appointment, the session fee will be refunded minus $150. If however a behind-the-wheel session is cancelled less than 48 hours before the scheduled appointment, no refund will be provided. If behind-the-wheel is partially cancelled or a reschedule is requested by the student, parent or guardian, no refund will be provided and each addition hour of driving thereafter will be assessed at the rate of $75.00 per hour (or the then prevailing rate). 21. Students and parents or legal guardians will be responsible for any damage to NC DRIVING 101 materials and automobiles during ordinary course of driving with an instructor, even when students are learning how to drive. If student is out on the roads and highways, student still has a legal duty to drive in a reasonably safe manner. That means obeying stop signs and traffic signals, checking blind spots before changing lanes, yielding correctly, staying on their side of the road (i.e. not crossing over the center line into oncoming traffic nor driving over the right boundary line onto the shoulder), and obeying posted speed limits. 22. While NC DRIVING 101 will exert its best efforts in teaching the student to meet the requirements of the NC Division of Motor Vehicles behind-the-wheel examination; the school cannot guarantee that the student will successfully pass the Division of Motor Vehicle exam upon completion of the driving course. The school does agree to exert its best efforts in teaching the Student to meet the requirements of the examination. It is the parent absolute responsibility to continue this education after student receives his or her NCDMV teen driving permit. NC Driving 101 has the absolute right to deny the issuance of a Driver Education Course Certificate Of Completion, if the instructor believes that the student is not ready for any reason for the NCDMV driving permit. 23. Under this agreement an instructor may not provide behind-the-wheel training to more than three individual students at one time. Student may be part of a multi-student driving class. 24.Student Cell Phones are prohibited in the automobile and shall be turned off or set to Do Not Disturb While Driving. 25. Waiver of Liability Relating to Coronavirus/COVID-19. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.NC Driving 101 cannot prevent you [or your child] from becoming exposed to, contracting, or spreading COVID-19 while utilizing NC Driving 101’s services or vehicle. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize NC Driving 101’s services and/or enter into NC Driving 101’s vehicle you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize NC Driving 101’s services and enter NC Driving 101’s vehicle. These services are of such value to me [and/or to my children,] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize NC Driving 101’s services and vehicle in person. WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against NC Driving 101 and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing NC Driving 101’s services and vehicle(s). I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. 26. BEHIND THE WHEEL TRAINING BY APPOINTMENT ONLY....Driving time REQUIRED for teen to get learners permit. This is if you have taken the in-class portion of the permit already and still need your behind-the-wheel driving experience. Failure by PAYER to communicate and schedule an appointment in writing with driving school prior to paying, driving school will withhold a processing fee of $150 from any refund. 27. Without a completed Restricted Instruction Permit (SBTS-800) that has been signed by a DMV representative, students cannot be scheduled for their behind-the-wheel classes. Students who are absent on the day of the Vision and Physical Condition Screening, students who forget their corrective lenses on the day of the screening or students whose paperwork was not filled out correctly will not have a Restricted Instruction Permit that has been signed by a DMV representative. If a student misses the Vision and Physical Condition Screening, NC Driving 101 may schedule a make-up day at our earliest availability or at the next scheduled screening. Students will not be put into the "ready to drive" file until the student has taken the vision & medical screening, and we have a completed Restricted Instruction Permit on file at NC Driving 101.
